Terms of Service

These Terms of Service ("Terms") govern your use of the DearMaps mobile application ("App") and the website at www.dearmaps.com ("Website"), collectively referred to as the "Service." By using the Service, you agree to these Terms.

The Service is provided by Woyava, a small independent studio based in Portugal ("we," "us," or "our").

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use DearMaps. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Your Account

You may use DearMaps as a guest without creating an account. To access social features (the public feed, cloud sync, and profile), you must create an account using Sign in with Apple or Google Sign-In.

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately if you suspect unauthorized access.

3. Service Tiers

DearMaps offers the following tiers:

• Guest: Free, local-only use. All data stays on your device. No account required.
• Signed-In (Free): Free with an account. Includes unlimited text memories, up to 7 photos per memory, cloud sync, and access to the public social feed.
• Pro: Paid subscription. Includes up to 20 photos and videos per memory, video and audio notes, unlimited Magic Scan, and custom categories.

We reserve the right to modify feature availability across tiers. Changes will not retroactively remove content you have already created.

4. Subscriptions & Payments

DearMaps Pro is available as:

• Monthly subscription
• Annual subscription
• One-time lifetime purchase

Payment processing is handled entirely by Apple through the App Store. Prices are set in the App Store and may vary by region. Applicable taxes are determined and collected by Apple.

Renewals: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID settings.

Refunds: Refund requests must be directed to Apple through their standard refund process. We do not process refunds directly.

Post-cancellation: If you cancel your Pro subscription, you retain access to all content you created during your subscription. Multimedia content (photos beyond 7, videos, audio) remains viewable but you cannot add new multimedia content beyond the free tier limits. Custom categories remain assigned to existing memories but you cannot create new ones.

5. Your Content

5.1 Ownership

You retain full ownership of all content you create in DearMaps, including memories, photos, videos, audio notes, and text ("Your Content"). We do not claim any ownership rights over Your Content.

5.2 Private Content

Content stored privately on your device and synced through Apple's cloud infrastructure is encrypted and inaccessible to us. We have no ability to access, view, moderate, or use your private content.

5.3 Published Content

When you choose to publish content to the public feed, you grant DearMaps a non-exclusive, worldwide, royalty-free license to host, display, distribute, and cache that content for the purpose of operating the social feed. This license exists solely to enable the technical delivery of the feed and terminates when you unpublish or delete the content.

You represent that you have all necessary rights to any content you publish, and that it does not infringe on the rights of any third party.

6. Acceptable Use

You agree not to use DearMaps to:

• Publish content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Publish content that violates any person's privacy rights, intellectual property rights, or other legal rights
• Publish sexually explicit content involving minors
• Impersonate any person or entity
• Distribute malware, spam, or engage in any form of automated abuse
• Attempt to access other users' private data or circumvent security measures
• Reverse-engineer, decompile, or disassemble the App
• Use the Service for any commercial purpose without our written consent

We reserve the right to remove published content and suspend or terminate accounts that violate these rules.

7. Privacy

Your privacy is fundamental to DearMaps. Our Privacy Policy describes how we collect, use, and protect your data. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

8. Intellectual Property

The DearMaps app, website, brand, logo, design, and all related intellectual property are owned by Woyava. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our written permission.

The animations, icons, and visual assets used in the App are proprietary to DearMaps.

9. Third-Party Services

DearMaps integrates with a small number of trusted third-party service providers, including Apple's cloud infrastructure, our authentication and social backend providers, our crash reporting service, and our subscription management service. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Data loss will never occur (we strongly recommend maintaining backups through iCloud)
• The Service will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by applicable law, Woyava shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

12. Indemnification

You agree to indemnify and hold harmless Woyava from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Account Termination

13.1 By You

You may delete your account at any time from within the App (Settings → Delete Account). Upon deletion:

• Your account and all associated data on our servers are permanently deleted
• Published content is removed from the public feed
• This action is irreversible
• Active subscriptions should be cancelled separately through Apple's App Store settings to avoid continued billing

13.2 By Us

We may suspend or terminate your account if you materially violate these Terms, engage in illegal activity, or abuse the Service. We will make reasonable efforts to notify you before or at the time of termination, unless doing so would compromise safety or legal obligations.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you disagree with any changes, you should stop using the Service and delete your account.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Portugal.

If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.

You may also use the European Commission's Online Dispute Resolution (ODR) platform for resolving disputes.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Woyava regarding the use of DearMaps. They supersede all prior agreements and understandings.
